1. Akito is a girl. 2. In the manga, obviously. 3. In the anime, too. This is because, guess what, they are making a second season. And Shigure-chan and Akito are in a relationship, yet, they arn't gay and Shii-chan is a boy. Akito. Is. A. Girl.

Kureno even tells Tohru that Akito is a girl. He says that even though he is no longer cursed that he stays because he hates to see that girl cry. Also Kureno and Shigure have been with Akito. So Akito is a girl. Not a boy. Thats also why she hates Rin so much, because Akito is afraid that Rin will take all the male 12shi away from her.
