Kabuto isn't actually going to kill Sasuke. He is doing that because he know Kakashi is there and he is getting ready to act. So kabuto is after Kakashi. Kabuto would never go against Orochimaru, that is why he isn't going to kill Sasuke.  Because Kabuto says just what I'd expect of you, Kakashi-san. To stop my attack on you from your blind spot. So yeah, he was out to attack Kakashi not kill Sasuke.
